Acceptance of Terms
By accessing our website, registering for our services, or using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you are under 18 years of age, you must have your parent or guardian's consent to use our services and they must agree to these Terms on your behalf.
Services Description
Zenith Academy provides online tutoring services for students across various academic subjects and year levels with a focus on WACE ATAR subjects. Services are delivered via our online platform or other secure video conferencing platforms approved by Zenith Academy.
Our services include but are not limited to:
Personalised, one-on-one tutoring tailored to students' goals and learning styles
Regular feedback and progress updates
Access to customised resources and practice materials
Development of effective study skills and exam techniques
Support in building academic confidence
User Accounts and Registration
To access certain features of our services, you must register for an account.
You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and for all activities that occur under your account.
You agree to notify us immediately of any unauthorised use of your account or any other breach of security.
Payment Terms
Fees for our services are as outlined on our website and in the service agreements.
Payment shall be made weekly or monthly via credit/debit card, PayPal, bank transfer or other approved form of payment.
Invoices will be sent by email containing secure payment links. Payment is due within seven (7) days of invoice date.
Failure to make payment by the due date may result in suspension of services until the account is brought current.
Prices may be subject to change with fourteen (14) days' written notice.
Cancellation and Rescheduling Policy
A minimum of 24 hours' notice is required for cancellations or rescheduling of sessions.
If less than 24 hours' notice is provided, you may incur a cancellation fee of 50% of the session fee.
To reschedule a session, you can click the reschedule link in the session confirmation email or contact Zenith Academy's support team.
If a tutor needs to cancel or reschedule a session, Zenith Academy will provide as much notice as possible and will offer an alternative session time or tutor at no additional cost.
Refund Policy
Refunds are available only for sessions with valid cancellation (24+ hours notice) and at the discretion of the Zenith Academy team or in line with the consumer law of Australia.
No refunds will be provided for sessions that have already been completed.
Refund requests must be submitted in writing to Zenith Academy.
Student and Parent Conduct
Students and parents agree to:
Attend scheduled sessions on time
Provide a suitable environment for online learning during sessions
Complete any assigned homework or tasks
Communicate any concerns or changes in academic needs to Zenith Academy
Maintain respectful communication with tutors and staff
Zenith Academy reserves the right to terminate services if a student engages in disruptive behavior that prevents effective tutoring.
Intellectual Property
All content, materials, and resources provided by Zenith Academy, including but not limited to study notes, worksheets, and practice exams, are the property of Zenith Academy and are protected by intellectual property laws.
You may use these materials solely for your personal educational purposes and may not distribute, reproduce, modify, or create derivative works without our express permission.
Privacy and Data Protection
All tutoring sessions are automatically recorded for safety and quality assurance purposes. These recordings are stored securely and are only accessible to authorized personnel.
We collect and store student data in accordance with the Australian Privacy Act 1988 (Cth) and Western Australian privacy laws.
Student data will only be used for the purposes of providing our services and will not be shared with third parties except as required by law.

Child Safety
All Zenith Academy tutors are required to have valid Working With Children Checks (WWCC) and are bound by strict child safety policies.
All tutors are required to maintain appropriate professional boundaries with students at all times.
We are committed to providing a safe learning environment for all students.
Performance and Results
Zenith Academy strives to provide high-quality tutoring services designed to improve students' academic performance.
While Zenith Academy will make best efforts to help students achieve their academic goals, no specific grade improvements or examination results can be guaranteed, as these depend on multiple factors including the student's effort, attendance, and application of learning.
Limitation of Liability
To the maximum extent permitted by law, Zenith Academy's liability is limited to the amount paid for the services.
Zenith Academy shall not be liable for any indirect, consequential, or special damages arising from these Terms.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded by law.
Force Majeure
Zenith Academy shall not be liable for any failure or delay in performing its obligations where such failure or delay is due to causes beyond its reasonable control, including but not limited to natural disasters, power outages, network failures, or government restrictions.
Dispute Resolution
The parties shall attempt to resolve any disputes arising from these Terms through good faith negotiations.
If the dispute cannot be resolved through negotiation within thirty (30) days, either party may refer the matter to mediation.
If mediation is unsuccessful, either party may pursue legal remedies in the courts of Western Australia, which shall have exclusive jurisdiction over any disputes arising from these Terms.
General Provisions
Entire Agreement: These Terms constitute the entire understanding between the parties and supersede all prior agreements, understandings, or negotiations.
Amendments: We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes acceptance of the revised Terms.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver: No waiver of any breach of these Terms shall be deemed a waiver of any subsequent breach.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of Western Australia.
